1) Privacy Policy

We appreciate your visit to our websites and your interest in our solutions and products. The protection of your personal data is important to us. In these privacy notices, we explain how we collect your personal data, what we do with it, for what purposes and on what legal bases this occurs, and what rights and claims are associated with it for you.

Our privacy notices for the use of our websites and our privacy policy do not apply to your activities on the websites of social networks or other providers that you can reach via links on our websites. 2) Collection and Processing of Your Personal Data

a) When you visit our websites, we store certain information about the browser and operating system you use, the date and time of your visit, the access status (e.g., whether you were able to access a website or received an error message), the use of website functions, any search terms you may have entered, the frequency with which you visit individual web pages, the name of retrieved files, the amount of data transferred, the website from which you accessed our websites, and the website you visit from our websites, either by clicking on links on our websites or by entering a domain directly into the input field of the same tab (or window) of your browser in which you opened our websites. Furthermore, for security reasons, particularly to prevent and detect attacks on our websites or attempted fraud, we store your IP address and the name of your Internet Service Provider for a period of seven days.

b) We only store other personal data if you provide us with this data, for example, during registration, via a contact form, or in a survey, and even in these cases, only insofar as we are permitted to do so based on your consent or applicable legal provisions (further information on this can be found below in the section "Legal Basis for Processing").

c) You are neither legally nor contractually obliged to provide your personal data. However, it is possible that certain functions of our websites depend on the provision of personal data. If you do not provide personal data in these cases, this may result in functions not being available or being available only to a limited extent.

3) Purposes of Use

a) We use the personal data collected during your visit to our websites to operate them as conveniently as possible for you and to protect our IT systems from attacks and other unlawful acts.

b) If you provide us with further personal data, for example, during registration, via a contact form, or in a survey, we use this data for the stated purposes, for customer administration purposes, and – where necessary – for the processing and billing of any business transactions, each to the extent required for that purpose.

4) Transfer of Personal Data to Third Parties; Social Plug-ins; Use of Service Providers

a) If you click on a link to an external website, we transfer data to the respective provider to the extent necessary (e.g., the information that you accessed this link from our site and, if applicable, further information that you have already provided on our websites for this purpose).

b) If we use so-called "social plug-ins" from social networks such as LinkedIn, Xing, and Instagram on our websites, we integrate them as follows:

When you visit our websites, the social plug-ins are deactivated, meaning no data is transferred to the operators of these networks. If you wish to use one of the networks, click on the respective social plug-in to establish a direct connection with the server of that network.

If you have a user account with the network and are logged in at the moment of activating the social plug-in, the network may associate your visit to our websites with your user account. If you wish to avoid this, please log out of the network before activating the social plug-in.

If you activate a social plug-in, the network directly transfers the content thereby made available to your browser, which integrates it into our websites. In this situation, data transfers initiated and controlled by the respective social network may also occur. Your connection to a social network, the data transfers between the network and your system, and your interactions on that platform are exclusively governed by the privacy policies of the respective network.

The social plug-in remains active until you deactivate it or delete your cookies.

c) If you click on a link to a linked website or activate a social plug-in, personal data may be transferred to providers in countries outside the European Economic Area which, from the perspective of the European Union ("EU"), do not guarantee an "adequate level of protection" for the processing of personal data in accordance with EU standards. Please consider this before clicking a link or activating a social plug-in and thereby triggering a transfer of your data.

d) For the operation, optimization, and security of our websites, we also engage qualified service providers (IT service providers, marketing agencies). We only transfer personal data to these providers to the extent necessary for the provision and use of the websites and their functionalities, for the pursuit of legitimate interests, or if you have consented to it (see Section 8). Data may be transferred to recipients outside the European Economic Area; please refer to Data Transfer to Recipients Outside the European Economic Area for more information.

5) Evaluation of Usage Data; Use of Analysis Tools

a) We aim to tailor the content of our websites as precisely as possible to your interests and thereby improve our offerings for you. To identify user preferences and particularly popular areas of the websites, we use the following analysis tool(s): Google Analytics and HubSpot for our online marketing activities.

b) If you do not want us to collect and evaluate information about your visit to our websites using the aforementioned analysis tools, you can object to this at any time for the future ("Opt-Out").

We implement your objection by placing an opt-out cookie in your browser. This cookie is solely used to register your objection. 6) Usage-based Information (Targeting and Retargeting)

To better tailor our online marketing (e.g., banner advertising) on the websites of our retargeting partners (Google Adwords) to your needs and interests, we use so-called retargeting technologies. These involve storing your interest in our products and services in cookies. When you visit other websites that collaborate with our retargeting partners, these cookies are read and used to provide you with information that is as relevant as possible to your interests. This process is anonymized, meaning you cannot be identified through retargeting.

If you do not want us and our retargeting partners to collect, store, and analyze information about your visit, or to tailor banner advertising to your interests, you can object to this at any time for the future (opt-out).

7) Security

We implement technical and organizational security measures to protect your data managed by us against manipulation, loss, destruction, and access by unauthorized persons. We continuously improve our security measures in line with technological developments.

8) Legal Bases for Processing

a) Insofar as you have given us consent for the processing of your personal data, this constituted the legal basis for the processing (Art. 6 para. 1 lit. a GDPR).

b) For the processing of personal data for the purposes of initiating or fulfilling a contract with you, Art. 6 para. 1 lit. b GDPR is the legal basis.

c) Insofar as the processing of your personal data is necessary for the fulfillment of our legal obligations (e.g., for data retention), we are authorized to do so in accordance with Art. 6 para. 1 lit. c GDPR.

d) Furthermore, we process personal data for the purposes of pursuing our legitimate interests and the legitimate interests of third parties in accordance with Art. 6 para. 1 lit. f GDPR. Such legitimate interests include maintaining the functionality of our IT systems, as well as marketing our own and third-party products and services, and the legally required documentation of business contacts. In the context of the necessary balancing of interests, we particularly consider the type of personal data, the purpose of processing, the processing circumstances, and your interest in the confidentiality of your personal data.

9) Deletion of Your Personal Data

We delete your IP address and the name of your Internet Service Provider, which we store only for security reasons, after seven days. Otherwise, we delete your personal data as soon as the purpose for which we collected and processed the data ceases to apply. Beyond this point, data storage only occurs if required by laws, regulations, or other legal provisions to which we are subject, either in the EU or under legal provisions in third countries, provided an adequate level of data protection is guaranteed there. If deletion is not possible in individual cases, the corresponding personal data will be marked with the aim of restricting their future processing.

10) Data Subject Rights

a) As a data subject, you have the right to information (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR), and data portability (Art. 20 GDPR).

b) If you have given your consent to the processing of your personal data by us, you have the right to withdraw your consent at any time. The lawfulness of the processing of your personal data until withdrawal is not affected by the withdrawal. Further processing of this data based on another legal basis, such as for the fulfillment of legal obligations (cf. section "Legal Bases for Processing"), also remains unaffected.

c) Right to object. You have the right to object, on grounds relating to your particular situation, at any time to the processing of personal data concerning you which is based on Art. 6 para. 1 e) GDPR (data processing in the public interest) or Art. 6 para. 1 f) GDPR (data processing based on a balancing of interests). If you object, we will only continue to process your personal data if we can demonstrate compelling legitimate grounds that override your interests, rights, and freedoms, or if the processing serves the establishment, exercise, or defense of legal claims.

e) If you believe that the processing of your personal data violates legal requirements, you have the right to lodge a complaint with a competent data protection supervisory authority (Art. 77 GDPR).

11) Data Transfer to Recipients Outside the European Economic Area

a) When using service providers (see section 4. d.), analysis tools (see section 5), and retargeting technologies (see section 6), personal data may be transferred to and processed by recipients in countries outside the European Union (“EU”), Iceland, Liechtenstein, and Norway (= European Economic Area), particularly the USA and India.

b) From the EU's perspective, the following countries have an adequate level of protection for the processing of personal data in accordance with EU standards (so-called adequacy decision): Andorra, Argentina, Canada (limited), Faroe Islands, Guernsey, Israel, Isle of Man, Japan, Jersey, New Zealand, Switzerland, Uruguay. With recipients in other countries, we agree to the application of EU standard contractual clauses, binding corporate rules, or the EU-U.S. or Swiss-U.S. Privacy Shield, in order to establish an adequate level of protection in accordance with legal requirements. We will gladly provide you with information on this via the contact details mentioned in section 10.d. above.

“Cookies” are small files stored on users' computers. Different information can be stored within cookies. A cookie primarily serves to store information about a user (or the device on which the cookie is stored) during or after their visit to an online offering. Temporary cookies, also known as “session cookies” or “transient cookies,” are cookies that are deleted after a user leaves an online offering and closes their browser. Such a cookie can, for example, store the content of a shopping cart in an online shop or a login status. “Permanent” or “persistent” cookies are those that remain stored even after the browser is closed. We reserve the right to adapt this privacy policy to ensure it always complies with current legal requirements or to implement changes to our services within the privacy policy, e.g., when introducing new services. The new privacy policy will then apply to your next visit.
